The use license, also known as use permit, is a document issued by the Municipal Council that attests that a property meets the necessary conditions for its intended purpose, whether residential or non-residential (such as commerce, services, or industry). This document is fundamental to ensure that the property is in compliance with approved projects and current legal and regulatory norms, including aspects of safety, health, and suitability for the intended use.

What the Use License is For

  • Compliance Proof:

The license certifies that the property has been inspected and meets the permitted use norms.

  • Necessity in Real Estate Transactions:

It is mandatory for the sale or rental of properties. Without it, it is not possible to legally complete these transactions.

  • Requirements for Credit:

To obtain a housing loan, financial institutions require the presentation of the use license.

  • Alterations and Works:

If works are carried out that alter the structure or use of the property, it may be necessary to request a new use license after completion of the works.

Exception Situations

  • Buildings constructed before August 7, 1951, when the General Urban Building Regulations were not in force, may be exempt from presenting this license.

  • The use license is an essential document to ensure that the property’s use is in accordance with legal norms and that all parties involved in real estate transactions are protected.

  • In buildings that are in ruins, in which case a ruin declaration is issued.
